DIRECTION

The Court requests the Registry to provide this Direction to the parties and post it on the Court’s website. It addresses various issues relating to the hearing of this appeal.

Schedule

This appeal is scheduled to be heard on June 25 and 26, 2024 for one day and 3 hours. The total hearing time, inclusive of three 15-minute recesses, will be 8 hours 30 minutes. The appellant and respondent each have approximately 4 hours and 15 minutes, inclusive of time allotted to or used by supporting interveners.

Accordingly, the hearing will proceed as follows, subject of course to more convenient break points based on the flow of arguments and the discretion of the panel:

Order of Argument

Counsel for the parties and interveners are requested to determine, amongst themselves, the order in which interveners will speak and length of submissions. Counsel are reminded that the orders granting leave to intervene limited oral submissions to 15 minutes per intervener. Again, this is subject to the panel’s discretion to manage the hearing as it considers appropriate.

Compendia, Condensed Books and Day Books

Counsel are directed to Federal Courts Rule 348.1 and the Consolidated Practice Direction, paras. 59-64 for a description of the content and purpose of each. If counsel decide to prepare any of these materials, 7 copies are requested.

Access to the Courtroom and Hearing

The following information is to be posted to the website of the Federal Court of Appeal and also be supplied to counsel in this appeal.

The public gallery in the Federal Court of Appeal’s courtroom is very small. Counsel for the parties, interveners and their representatives who must present in person to instruct counsel are likely to use all available seating.

However, those interested in observing the hearing live may do so online. The necessary information on how to watch the hearing is available on the Federal Court of Appeal’s website or, if necessary, may obtained by contacting the Registry of the Federal Court of Appeal at Information@fca-caf.gc.ca.

Again, due to space limitations, there will be no physical facilities available on the premises of the Federal Court of Appeal to watch the online broadcast of the hearing. Therefore, those interested in watching the hearing are invited to do so online.

Public and Media Access
