DIRECTION

  The following information shall be posted to the website of the Federal Court of Appeal and to its social media accounts. It shall also be supplied to counsel in this appeal.

  This Direction may also be circulated to any interested members of the public

  The hearing of this appeal is scheduled for 2 hours and 30 minutes on November 8, 2023. The hearing will start at 9:30 a.m. EST in Toronto.

  The Court understands that many members of the public may be interested in the hearing. The following is important information:

• The public gallery in the Federal Court of Appeal’s courtroom in Toronto is small. Hence, counsel for the appellants will provide a list of a maximum of 50 of his clients who will attend the hearing and counsel for the respondents will provide a list of a maximum of 5 names of his clients who will attend the hearing;
• Counsel for the appellants and counsel for the respondents shall provide their list of names to the Registry no later than 3:00 p.m. on Monday, November 6, 2023;
• However, interested members of the public not on the lists are encouraged to watch the hearing online;
• Interested persons may request a link to view the hearing on the Upcoming Hearings page of the Court of Appeal website. After locating the hearing in the hearings list, they can click “Register” and fill in their contact information;
• On the day of hearing, anyone not appearing on either lists and who show up to watch the hearing will be turned away;
• The Court’s Guidelines on Public and Media Access apply to this hearing. It is prohibited to take photos or screen-captures during the hearing or to broadcast or distribute the hearing or later, court-supplied recordings of the hearing, in whole or in part.
