Notice to the public about the hearing in Hon. A. Brian Peckford et al. v. Canada (Attorney General) (A-251-22), Shaun Rickard et al. v. Canada (Attorney General) (A-252-22), Hon. Maxime Bernier v. A.G.C. (A-253-22) and Nabil Ben Naoum v. Canada (Attorney General) (A-254-22)
DIRECTION
The following information shall be posted to the website of the Federal Court of Appeal and to its social media accounts. It shall also be supplied to counsel in this appeal.
This Direction may also be circulated to any interested members of the public.
The hearing of these appeals is scheduled for 3 hours on October 11, 2023. The hearing will start at 9:30 a.m. EDT. The appeals are all being heard together.
The parties requested that the hearing be held in Ottawa. The Court granted that request.
The Court understands that many members of the public may be interested in watching the hearing live. The following is important information for them.
Members of the public should not try to attend the hearing in person. The public gallery in the Federal Court of Appeal’s courtroom in Ottawa is very small. Only the parties and their counsel may attend the hearing in person. Any members of the public who show up in person to watch the hearing will be turned away.
However, interested members of the public are encouraged to watch the hearing online.
Interested persons may request a link to view the hearing on the Upcoming Hearings page of the Court’s website. After locating the hearing in the hearings list, they can click “Register” and fill in their contact information. The Registry will send them an invitation with a link to view the hearing. Although each of the appeals being heard together on October 11 has a registration link, it is only necessary to register for one of the cases. They will be admitted for all four.
The Court encourages those intending to view the hearing to register as soon as possible. Hearing links are generated manually by the Registry, who may not be able to respond to a large number of requests received at the last minute.
The Court’s Guidelines on Public and Media Access apply to this hearing. It is prohibited to take photos or screen-captures during the hearing or to broadcast or distribute the hearing or later, court-supplied recordings of the hearing, in whole or in part.
