Costs

This page contains information but does not contain legal advice. Parties are strongly encouraged to seek legal advice from competent counsel.

When one party is successful in a legal proceeding and another is not, the Court may decide to order costs against the unsuccessful party.

The Rules about costs are generally found in Part 11 of the Federal Courts Rules .

Parties should be ready to speak to the issue of costs at the time of the hearing of their matter.

If the Court awards costs without specifying a monetary amount, parties may request an appointment to have their costs assessed by an assessment officer. A bill of costs is typically prepared for this purpose.
